1. What information do we collect?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal information provided by you

The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • Names
  • Phone numbers
  • Email addresses

Sensitive information

We do not process sensitive information.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and usage data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
  • Device data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

2. How do we process your information?

In short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
  • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
  • To deliver targeted advertising to you. We may process your information to develop and display personalized content and advertising tailored to your interests, location, and more.
  • To determine the effectiveness of our marketing and promotional campaigns. We may process your information to better understand how to provide marketing and promotional campaigns that are most relevant to you.
  • To understand how our Services are used and to keep them working. We may process your information to measure how visitors use our Services, to measure how well our pages perform, and to find and fix errors.

4. When and with whom do we share your personal information?

In short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • CRM and engagement platforms. We use Follow Up Boss to manage client relationships. When you submit a contact form, newsletter request, or similar on our website, we transmit the information you provide to Follow Up Boss over secure connections so our team can respond and run permitted automations. We may also load Follow Up Boss's website widget (script from Follow Up Boss / its vendor host) so that, after you are identifiable to our CRM (for example because you submitted a form or used a tracked link), on-site activity may be associated with your record as described in Follow Up Boss's product and privacy materials. We suppress the visible floating contact prompt on our pages while that script may remain active. For more information, see Follow Up Boss privacy.
  • Analytics and advertising measurement providers. We use Google (Google Analytics 4 and Google Tag Manager) and Meta (the Meta Pixel). When these tools are on, information about your visit, such as your IP address, your browser and device, the pages you view, and the actions you take, is sent to Google and Meta. See Do we use cookies and other tracking technologies? for when these tools run and how to turn them off.
  • Error monitoring. We use Sentry to receive error reports and page performance data from our Services and, for some visits, session recordings. See Do we use cookies and other tracking technologies? for details.
  • Business transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API). Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors. This data helps Google Maps provide directions, but it is not always perfectly precise.

5. Do we use cookies and other tracking technologies?

In short: We use cookies and other tracking technologies. Analytics and advertising measurement depend on your choice and your location; the other technologies we use are described below.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.

To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies at any time with Your Privacy Choices or a Global Privacy Control signal, as described below, or by submitting a request as described under Do United States residents have specific privacy rights?

Analytics and advertising tools we use

We use three tools for analytics and advertising measurement:

  • Google Analytics 4 helps us understand how visitors use the Services.
  • Google Tag Manager loads Google Analytics 4 and the Meta Pixel on our pages.
  • The Meta Pixel sends Meta information about visits to the Services so that we can measure how well our advertising performs.

When these tools run

Where you are decides when they start. If you are in the European Economic Area (the European Union, Iceland, Liechtenstein, and Norway), the United Kingdom, Switzerland, or Quebec, or if we cannot tell where you are, we show a consent banner, and no analytics or advertising measurement runs until you choose. Everywhere else, analytics and advertising measurement are on by default, and you can switch them off at any time.

We use Google Consent Mode to pass your choices to Google's tags. In plain terms: where we show the consent banner, Consent Mode tells Google that analytics and advertising are not allowed until you choose. Everywhere else, it starts as allowed, and it changes to not allowed when you switch a choice off or when your browser sends a Global Privacy Control signal.

A Global Privacy Control signal from your browser is always treated as an opt-out of advertising measurement and sharing, in every region and without any login. See Controls for Do-Not-Track features and Global Privacy Control.

Your Privacy Choices

You can change your choices at any time. Select the small cookie icon at the bottom right of any page, or the Your Privacy Choices link in the footer. Both open the same panel, with separate Analytics and Advertising choices.

We store your choice in your browser, in local storage and in a cookie, for 1 year. We also set a small cookie that records your country or region so that we show the right consent behavior. If you clear your browser data or use a different browser or device, you will need to choose again.

Google Analytics 4

Google Analytics 4 keeps its data for 14 months. To stop it from tracking you on the Services, turn off Analytics in Your Privacy Choices. The Google Analytics Advertising Features that we may use include: Google Analytics Demographics and Interests Reporting. To opt out of being tracked by Google Analytics across the Services, visit tools.google.com/dlpage/gaoptout. You can opt out of Google Analytics Advertising Features through Ads Settings and Ad Settings for mobile apps. Other opt-out means include optout.networkadvertising.org and networkadvertising.org/mobile-choice. For more information on the privacy practices of Google, please visit the Google Privacy & Terms page.

Google Tag Manager

Google Tag Manager is a tool that loads other tags on our pages. We use it to load Google Analytics 4 and the Meta Pixel. It follows the rules in "When these tools run" above: where we show the consent banner, it does not load these tags unless you allow analytics or advertising.

Meta Pixel

The Meta Pixel is a tool from Meta, the company behind Facebook and Instagram. When it runs, it sends Meta information about your visit to the Services, such as the pages you view, so that we can measure how well our advertising performs. It is part of the advertising measurement that the Advertising choice in Your Privacy Choices and a Global Privacy Control signal turn off. For more information on Meta's privacy practices, see facebook.com/privacy/policy.

Technologies your Analytics and Advertising choices do not control

Some technologies on the Services are not turned on or off by your Analytics and Advertising choices. We describe them here instead:

  • Error monitoring (Sentry). We use Sentry to find and fix problems. It receives error reports and page performance data, along with a random visitor ID that we store for 1 year in a first-party cookie named sentry_anon_id, so that we can count how many visitors an error affects. For a sample of visits (about 10%) and for every visit in which an error occurs, Sentry Session Replay records the visit. On-screen text, form inputs, and media are masked or blocked by default. We use this information to keep the Services working, not for advertising.
  • First-party analytics. Our own servers record page views, actions you take on the Services (such as applying a filter, saving a listing, or submitting a form), and page performance measurements, and store them in our database. We use them for our own reporting.
  • Follow Up Boss. Our customer relationship management provider's website widget may set or read cookies. It is described below.
  • Sign-in and preferences. If you sign in, we set cookies that keep you signed in. We also store display preferences, such as how you like to view listings, in your browser's local storage. These support features you use.

Follow Up Boss

We use Follow Up Boss pixel / widget technology that may set or read cookies or similar data and communicate with Follow Up Boss servers to correlate site usage with contacts in our CRM when permitted by their product (for example after you submit a form or click an identified link). We do not show the floating contact prompt on our pages while that technology may still run. We also send lead events from our servers to Follow Up Boss when you request contact or subscribe. This technology is not turned on or off by your Analytics and Advertising choices. You can read more at followupboss.com/privacy.

6. How long do we keep your information?

In short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us, except for the periods described under Do we use cookies and other tracking technologies? Google Analytics 4 keeps its data for 14 months, and we store your consent choice in your browser for 1 year.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. How do we keep your information safe?

In short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. Do we collect information from minors?

In short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at info@owncabohomes.com.

9. What are your privacy rights?

In short: Depending on your state of residence in the US or in some regions, such as Canada, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

In some regions (like Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us using the contact details provided in How can you contact us about this notice? below.

We will consider and act upon any request in accordance with applicable data protection laws.

Withdrawing your consent

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us using the contact details provided in How can you contact us about this notice? below.

To withdraw your consent to analytics and advertising measurement, use Your Privacy Choices at any time: select the small cookie icon at the bottom right of any page, or the Your Privacy Choices link in the footer. You do not need to contact us.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in How can you contact us about this notice? below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Account information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You can also manage analytics and advertising tools with Your Privacy Choices, described under Do we use cookies and other tracking technologies?

If you have questions or comments about your privacy rights, you may email us at info@owncabohomes.com.

10. Controls for Do-Not-Track features and Global Privacy Control

Do-Not-Track

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online, other than Global Privacy Control, described below. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.

California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

Global Privacy Control

Global Privacy Control ("GPC") is a browser setting, or a browser extension, that sends a signal asking websites not to sell or share your personal information. Unlike DNT, we honor it. When your browser sends a GPC signal, we treat it as an opt-out of advertising measurement and sharing, in every region, and you do not need to sign in or take any other step.

GPC applies to advertising. To turn off analytics as well, use Your Privacy Choices, described under Do we use cookies and other tracking technologies?

11. Do United States residents have specific privacy rights?

In short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. More information is provided below.

Will your information be shared with anyone else?

We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Learn more about how we disclose personal information in When and with whom do we share your personal information?

We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal information.

Our advertising measurement tools, the Meta Pixel and the Google Analytics Advertising Features we may use, send information about your visit, such as an online identifier, your IP address, the pages you view, and the actions you take, to Meta and Google. To the extent this is deemed a "sale" or "sharing" of personal information, or targeted advertising, under applicable US state laws, you can opt out as described below. Outside the regions where we ask for your choice first, these tools are on by default until you opt out.

Other than this advertising measurement, we have not disclosed, sold, or shared any personal information to third parties for a business or commercial purpose in the preceding twelve (12) months.

  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including California's privacy law)

  • Use Your Privacy Choices. Select the small cookie icon at the bottom right of any page, or the Your Privacy Choices link in the footer, and turn off Advertising.
  • Send a Global Privacy Control signal. If your browser or a browser extension sends a GPC signal, we treat it as an opt-out of advertising measurement and sharing, in every region, without any login. See Controls for Do-Not-Track features and Global Privacy Control.

These choices apply to the browser you use to make them. You can also send us a request using the contact details below.
